The Order was issued by the High Court on Tuesday 21 April 2026. Waverley Borough Council is the Claimant.

Further directions

The hearing of the Claimant’s Claim for a section 187B injunction shall be listed to be heard on the first available date after 2 June 2026 with a time estimate of two days (“the Final Hearing”), unless the Planning Application is made valid by 4pm on 30 April 2026, or a Ground A appeal is lodged against the served Enforcement Notice by 1159pm on 21st May 2026.

If the Planning Application submitted to the Claimant is made valid by 4pm on 30 April 2026 or a Ground A appeal against the Enforcement Notice is lodged, then the hearing of the Claimant’s Claim for a section 187B injunction shall be listed to be heard on the first available date (with a time estimate of two days) six weeks after the determination of that planning application by the Claimant or, if an appeal is made in accordance with paragraph 14 below to the Secretary of State, or, if an appeal is made against the Enforcement Notice in accordance with paragraph 12 above, the determination of that appeal by the Secretary of State.
