Council urges businesses to review Health & Safety Compliance

Waverley Borough Council is calling on all businesses to urgently review their health and safety practices following a successful prosecution that resulted in a substantial fine.

On 10 November 2025, Everyman Motor Racing Limited was fined £13,000, ordered to pay costs of £11,835, and a victim surcharge of £2,000 at Staines Magistrates Court, after pleading guilty to offences under Section 33 of the Health and Safety at Work etc. Act 1974.

The case arose from a serious accident on 13 August 2022 at Dunsfold Park, Surrey, during a driving experience event. A spectator was struck by a storm bar that fell from an awning, causing life-changing injuries. A subsequent inspection by Waverley’s Environmental Health Officers revealed ongoing poor health and safety standards.

Councillor Tony Fairclough, Portfolio Holder for Enforcement and Regulatory Services, said:
“This case is a stark reminder that health and safety failures can have devastating consequences. Businesses must take their responsibilities seriously and ensure robust risk assessments are in place to protect visitors and staff. The council will not hesitate to take enforcement action, where standards fall short.”

Waverley Borough Council is urging all businesses to:

Review their arrangements for protecting health and safety
Conduct suitable and sufficient risk assessments
Ensure premises and activities comply with legal requirements

Guidance on carrying out risk assessments is available from the Health and Safety Executive at www.hse.gov.uk.

Councillor Fairclough continued:  “My message to local businesses is clear; Please don’t wait for an incident to happen – action now can keep people safe and help avoid costly penalties.”
