The Documents of the Local Development Framework

The Local Development Framework is made up of a number of individual documents which will guide development of the area. The timetable for producing the individual documents is set out in the Local Development Scheme (LDS).

Waverley's Documents

The Local Development Framework is made up of  the following types of document:

• Development Plan Documents (DPDs)

Documents which are subject to public examination, have the weight of development plan status

• Supplementary Planning Documents (SPDs)

Documents which supplement policies in DPDs, but are not subject to examination and do not have development plan status

• Saved Policies

The majority of the policies in the adopted Waverley Borough Local Plan 2002 have been formally 'saved' and form part of the development plan until which time they are replaced by policies in Development Plan Documents (DPDs)

• Supporting Documents

A number of documents which outline various information such as how the community can get involved, the timetable for production and monitoring about how the planning policies are performing; and

• Evidence Base

A series of studies, documents and background evidence which provide information to support the production of the Local Development Framework.

Other Documents

In addition to the documents of Waverley's Local Development Framework there are other documents that currently form part of the development plan:

• Regional Spatial Strategy (South East Plan)
• Surrey County Waste and Minerals Plans and Policies

Update on the Status of Regional Spatial Strategies In July 2010, the new Government placed an order in Parliament to revoke Regional Spatial Strategies (RSS) with immediate effect. In August 2010, the developer CALA Homes (South) Ltd issued a legal challenge on the grounds that primary legislation was required and the revocation was unlawful. The High Court judgement was found in favour of CALA Homes. Following this, the government published a letter to Chief Planners re-iterating that the intention to abolish RSSs should be regarded as a material consideration in planning decisions. In May 2010, a judicial review appeal by CALA, which claimed that the Government's intention to revoke RSSs could never be a lawful consideration in decisions on planning applications, was rejected at the Court of Appeal. They concluded that the Government's intention to abolish Regional Strategies through primary legislation could be a material planning consideration in making development control decisions, but not in plan-making decisions.
